18-02-2020 Heard learned counsel for the parties.
The petitioner apprehends his arrest in Complaint Case No. 2136 of 2018 registered for the offence under Sections 498(A), 323/34 of the Indian Penal Code.
Petitioner is husband of the complainant and there is allegation of torture due to non-fulfillment of demand of dowry.
It appears that in spite of several notices, nobody appears on behalf of complainant/opposite party no. 2. It is submitted on behalf of petitioner that petitioner is ready to keep opposite party no. 2, as his wife, with full honour and dignity.
Patna High Court CR. MISC. No.22719 of 2019(9) dt.18-02-2020 2/2 Considering the aforesaid facts and circumstances as well as undertaking given by the petitioner, the provisional bail granted to the petitioner by this Court, vide order dated 09-04-2019, is, hereby, confirmed subject to following conditions:
"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.
(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
