The petitioner apprehends his arrest in Hathidah P.S. Case No.12 of 2019 registered under Sections 341, 354, 509, 504 of the Indian Penal Code.

The prosecutrix in sum and substance alleged that the petitioner hurled abusive language and also gave obscene and vulgar signals.

The learned counsel for the petitioner submits that in fact, there is a land dispute between two sides. Victim is the daughter of Raj Kishore Pandit. A proceeding under Section 107 Cr.P.C. being Case No.974 of 2018 was initiated against Bhola Das, first party and Raj Kishore Pandit, second party. Bhola Das is the father of the petitioner and Raj Kishore Pandit is the father of the informant. Shanti Devi, mother of the petitioner also

Patna High Court CR. MISC. No.22617 of 2019(2) dt.11-04-2019 2/2 lodged Hathidah P.S. Case No.14 of 2019 under Sections 341, 323, 504 and 34 of I.P.C. and Section 3(1)(R)(S) of S.C./S.T. Act against Rekha Devi, the mother and other family members of the informant.

Taking into consideration the fact that there appears a case and counter case and both the sides are on litigating terms on point of some land dispute, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. IV, Barh, District Patna in connection with Hathidah P.S. Case No.12 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
