Apprehending his arrest in connection with Case No.13C2 of 2016 registered for the offences under Sections 47(a) of the Old Excise Act, the petitioner has filed the present application under Section 438 of the Code of Criminal Procedure for grant of pre-arrest bail.

Regard being had to the recovery of 35 liters of country made liquor from the house of the petitioner, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, the prayer for grant of pre-arrest bail is rejected.

In case the petitioner surrenders and seeks bail, the same

Patna High Court Cr.Misc. No.31000 of 2017 (2) dt.13-07-2017 2/2 shall be considered on its own merits without being prejudiced in any manner by this order.
