JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2018 The petitioner is apprehending his arrest in connection with Madhuban P.S. Case No. 22 of 2016, registered for offences punishable under Section 394 of the Indian Penal Code. Allegation against the petitioner and others is committed loot of motorcycle of the informant.
It has been submitted by learned counsel for the petitioner that he has been named in this case only on the basis of confession of co-accused and there is nothing against the petitioner and no recovery has been made from the possession of the petitioner.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege
Patna High Court Cr.Misc. No.14162 of 2018 (2) dt.11-04-2018 2/2 of anticipatory bail to the petitioner rather the petitioner, if so desire may surrender before the court below and pray for regular bail, which will be considered by the court below on the basis of materials available on record.
