The petitioner apprehends his arrest in connection with Special P.S. Case no. 03 of 2017 (Kishanganj P.S. Case No.565 of 2016), registered under Sections 370, 372, 373 and 120(B) of the Indian Penal Code, Section 3,4 and 5 of the Immoral Traffic Prevention Act and Section 4/6 of the POCSO Act. The accusation is that on receiving secret information about flash trade going on in Mohalla Khagra, P.S. Kishanganj. The informant and other Police personnel raided the house of the petitioner, where one boy and girl were found in objectionable position. The girl disclosed her name as Moni Khatoon and she further disclosed that she was being carried there by Samina Khatoon, sister of the petitioner and this petitioner used to work as broker in flesh trade. Learned counsel for the petitioner submits that the boy

No.32479 of 2017 (3) dt.10-08-2017 2/2 and girl, who were found in objectionable condition from the place of occurrence, have not disclosed about indulging of petitioner in flesh trade, rather, the allegation is against Samina Khatoon and Samida Khatoon, sister and mother of the petitioner. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (POCSO Act), Kishanganj in connection with Special Case No. 03 of 2017 ( Kishanganj P.S. Case No. 565 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
