The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 409, 420, 467 and 468/34 of the Indian Penal Code.
Allegation against the petitioner is that she was a teacher appointed on contract basis. She continued receiving salary without attending the duties.
In pursuance of order dated 20.07.2017, the petitioner has already refunded entire salary received by her vide Annexure5 to the supplementary affidavit. Considering the aforesaid fact as well as the fact that the petitioner is a female, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a
Patna High Court Cr.Misc. No.32180 of 2017 (4) dt.21-09-2017 2 /2 period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Nawada/successor Court in connection with Sirdala Police Station Case No. 25 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
