This application for grant of anticipatory bail arises out of Kashichak (Shahpur O.P.) P.S. Case No. 36 of 2015, disclosing offence under Section 379 of the Indian Penal Code. From the First Information Report, it appears that there is allegation of committing theft of idol of Lord Budha from Village Paharpar.

Learned counsel appearing on behalf of the petitioner submits that he is not named in the First Information Report and his name has transpired on the basis of statement of some of coaccused persons. Considering the nature of allegation, I am not inclined to grant the petitioner privilege of anticipatory bail.

This application is, accordingly, rejected.

The petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail. Learned counsel for the petitioner has also submitted that some of similarly circumstanced co-accused persons have already been granted regular bail by the Court below. While considering the petitioner's application for grant of regular bail, the learned Court below may consider this aspect also.
