The petitioner is apprehending his arrest in connection with Town P.S.Case no.568 of 2016 registered for offences punishable under Sections 420/120(6) of the Indian Penal Code and Section 10 of Bihar School Examination Board, 1981.

Allegation against the petitioner as per FIR is that he allowed some other person to appear in place of him in the examination.

Submission of the learned counsel for the petitioner is that no seizure list of the petitioner has been prepared and the petitioner was not present at that time.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.14489 of 2018 (2) dt.12-04-2018 2/2 circumstances, as stated above, le the petitioner surrender within a period of four weeks from the date of receipt of this order and on his surrender, he will be released on provisional bail till submission of the charge-sheet, however, once the case is found true against the petitioner and the charge-sheet has been submitted, he has to surrender and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available at that time.

With the aforesaid observation, this application is disposed of.
