The petitioner is in custody in connection with Chakia P.S. Case No. 326 of 2018 registered for the offence under Sections 399, 402, 414 of the Indian Penal Code and Section 25 (1-b), a, 26, 35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Allegation against this petitioner is that on search one country made pistol with five live cartridges was recovered from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner is in custody since 09.12.2018.
Considering the fact that the petitioner has no criminal antecedent and he has remained in custody for four months. Let,
