JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-10-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 450, 376, 511 of the Indian Penal Code.
As per the prosecution case, this petitioner was caught while attempting to commit rape with the informant on the point of knife.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case due to village politics. In fact the mother of petitioner, namely, Urmila Devi, has given loan of Rs. 12,000/- to the informant, Pushpa Devi, but the informant refused to pay the loan amount and due to that some altercation has taken place between the petitioner and the informant and thereafter
Patna High Court CR. MISC. No.35597 of 2021(3) dt.25-10-2021 2/2 informant's husband and his relatives assaulted the petitioner and handed over him to police with false and concocted allegation. Petitioner claims clean antecedent and is in custody since 18.02.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Gangabridge PS case No. 34/2021.
