JUSTICE JYOTI SARAN ORAL ORDER 17-12-2015 Heard Mr. Rakesh Singh, learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant.

The petitioner apprehends his arrest in connection with Complaint Case No. 187 of 2014 for the offences punishable under Sections 406, 420, 341, 323 and 504 of the Indian Penal Code.

Mr. Rakesh Singh, learned counsel for the petitioner submits that the case in question is in retaliation to the complaint case instituted by the petitioner bearing Complaint Case No. 129 of 2014, a copy of which is placed at Annexure-2 series of the

Patna High Court Cr.Misc. No.53214 of 2015 (3) dt.17-12-2015 application. He submits that this complaint having been instituted on 12.5.2014 that after a lapse of 10 days the present complaint has been instituted on 22.5.2014 charging the petitioner of cheating on the informant and relieving him of Rs. 3,00,000/- on the pretext of securing a job for his son in the "Seema Suraksha Bal".

Having heard learned counsel for the parties and taking into consideration the circumstances existing as well as the nature of allegations forming part of the complaint, let the petitioner, namely, Arun Kumar Singh in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Daudnagar, District-Aurangabad and/or the court concerned in connection with Complaint Case No. 187 of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
