JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under section 304B of the Indian Penal Code.

As per the prosecution case, petitioner and other family members caused death of the daughter of the informant due to non-fulfilment of demand of dowry.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner and no specific overt act has been alleged against him who happens to be maternal uncle of the husband of the deceased. He is separate in mess and business and has no concern with the affairs of the deceased and her husband. Thrust

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Barh, Patna in NTPC Police Station Case No. 49 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
