The petitioner is apprehending his arrest in connection with NTPC P.S.Case no.44 of 2018 registered for offences punishable under Sections 382, 511, 307, 504, 34 of the Indian Penal Code.

Allegation as per FIR is that some miscreants siting on the railway line abused the Santry on duty and fired on him and on return fire, the accused persons fled away living Gamchha and Chappal . It further appears that on the basis of confessional statement of the co-accused the petitioner has been named in the FIR and he is accused in one more case under Section 379 of the IPC.

Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against him

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day.

With the aforesaid observation, this application is disposed of.
