The petitioner apprehends his arrest in Hasanpur P.S. Case No.12 of 2019 registered under Sections 47 and 30(a) of Bihar Prohibition and Excise Act.

The police raided mini constructed Deodha High School and bamboo bush and huge quantity of Indian made foreign liquor and spirit was recovered. The informant alleged that liquor was brought and kept by Awadh Kishor Roy(the petitioner) and his associates.

The learned counsel for the petitioner submits that petitioner has got no concern with the recovered liquor from the school and the bush. Nobody has seen the petitioner keeping the liquor in bush and in the newly constructed building of High School. On mere suspicion, the name of the petitioner has been

Taking into consideration the facts aforesaid and the fact that nothing has been recovered from the possession of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ III-cum-Special Judge, Excise, Samastipur in connection with Hasanpur P.S. Case No.12 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
