The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 341, 342, 323, 504, 332, 307, 337, 353, 427, 283 of the Indian Penal Code.
The prosecution case is that in protest against the murder of one Umesh Yadav the mob assaulted the informant and other Police Constables and put the Tata 407 vehicle on fire.
It is submitted by the learned counsel for the petitioner that accusation is omnibus and general against the mob. First Information Report has been lodged against 81 named and 100-200 unknown persons. Statement has been made in para-3 of the petition that petitioner has no
Patna High Court Cr.Misc. No.35919 of 2016 (2) dt.07-09-2016 criminal antecedent. Moreover, similarly situated coaccused persons have been granted bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 33219 of 2015. Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya in connection with Roshanganj P.S. Case No. 84 of 2011, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) P.K./- U T
