Petitioner apprehends arrest in a case registered under Section 414 of Indian Penal Code.
Allegation in the instant case is of recovery of two motorcycles from the house of the petitioner in presence of his father. The petitioner submits that he has falsely been implicated in this case as would be evident from the fact that one of the said stolen motorcycles alleged to have been recovered bearing Registration No BR-10C-9952 was purchased by him. In support of the same, he has annexed the certificate of registration (Annexure 2) to the instant petition. He further submits that he
Patna High Court Cr.Misc. No.32244 of 2017 (2) dt.13-07-2017 2/2 has no knowledge about the other motorcycle and the allegation of theft is false. Petitioner is said to have no criminal antecedent from before the instant case.
Considering the aforesaid submissions, prayer for anticipatory bail is allowed. In the event of his arrest or surrender within four weeks from today, the petitioner above named shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VII, Bhagalpur in Tatarpur Police Station Case No 146 of 2016, GR No 3712 of 2016 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
