The petitioners are apprehending their arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 420, 406, 467, 468, 471, 120B of the Indian Penal Code.

It is alleged that under an agreement for transfer of a piece of land in favour of the complainant, the petitioners received money, but subsequently they executed Power of Attorney to other person, who transferred the land. It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.53454 of 2015 (2) dt.24-11-2015 petitioners that the agreement was between the complainant and Arun Kumar and Lakhan Prasad Yadav. The Power of Attorney was executed in favour of Lakhan Prasad Yadav, who transferred the land.

Considering the accusation in the background of civil nature of dispute and the accused Arun Singh has been granted anticipatory bail vide Cr. Misc. No. 46134 of 2015, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Complaint Case No. 1962 of 2012, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
