Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Mehandiganj P.S. Case No. 58 of 2018 registered for the offences punishable under Sections 147, 148, 149, 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

This is the third attempt of the petitioner for his release on bail. While rejecting the petitioner's earlier prayer for regular bail vide order dated 03.09.2020, it was observed

No.34105 of 2021(5) dt.15-09-2021 2/2 that the petitioner shall be at liberty to renew his prayer for bail after six months, if there was no substantial progress at the trial. A supplementary affidavit has been filed on behalf of the petitioner stating specifically therein that there has been no progress at all at the the trial after passing of the said order dated 03.09.2020. He has further submitted that two of the coaccused persons have been allowed regular bail by this Court. Considering the above submission and the fact that the petitioner has remained in custody since 12.09.2018, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-III, Patna City in Mehandiganj P.S. Case No. 58 of 2018.
