Mr. Ram Sumiran Rai, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA KUMAR ORAL ORDER 11-04-2025 The present petition has been filed for modification of the order dated 23.10.2024, passed by this Court in Cr. Misc. No. 71870 of 2024.

2. Ld. counsel for the petitioners points out that except petitioner/Sita Devi, rest all the petitioners have two criminal antecedents bearing Chapra Muffasil P.S. Case No. 342 of 2020 and Chapra Muffasil P.S. Case No. 257 of 2021 and the same was mentioned in the bail petition by way of addition on instruction of the party. However, in paragraph-6 of the order

Patna High Court CR. MISC. No.23751 of 2025(2) dt.11-04-2025 2/3 dated 23.10.2024 passed in Cr. Misc. No. 71870 of 2024, it has been inadvertently mentioned that the petitioners have no criminal antecedents.

3. Accordingly, the order dated 23.10.2024 is modified to the extent that except petitioner No.5/Sita Devi, petitioner Nos. 1 to 4 have two criminal antecedents.

4. It is also pointed out by learned counsel for the petitioners that inadvertently in paragraph No.8 of the order dated 23.10.2024 passed in Cr. Misc. No. 71870 of 2024, it has been mentioned that bail bond should be submitted to the satisfaction of the learned Addl. Sessions Judge-V, Saran at Chapra. It also requires modification that bail bond should be allowed to file to the satisfaction of the concerned Court below.

5. Accordingly, in paragraph No.-6 of the order dated 23.10.2024, passed in Cr. Misc. No. 71870 of 2024, is modified to the extent that except petitioner No.5/Sita Devi, rest all the petitioner Nos. 1 to 4 have two criminal antecedents. Consequently, in paragraph No.8 of the order dated 23.10.2024, passed in Cr. Misc. No. 71870 of 2024 is modified to the extent that in place of the words "Additional Sessions Judge V, Saran at Chapra" be read as the "concerned Court below".

6. The time granted to surrender the petitioners in the

Patna High Court CR. MISC. No.23751 of 2025(2) dt.11-04-2025 3/3 Court below vide order dated 23.10.2024, passed in Cr. Misc. No. 71870 of 2024 has already elapsed. Hence, the time is extended by further eight weeks from today in connection with Chapra Muffasil P.S. Case No. 494 of 2020 for submitting the required bail bonds.

7. This order would be the integral part of the aforesaid bail order.

8. The present modification application stands allowed.
