Heard both parties.

The petitioner seeks bail in Athmalgola P.S. Case No. 219 of 2017, registered for the offence punishable under Sections 302, 120(B) and 34 of the Indian Penal Code. As per the prosecution case, this petitioner along with other named accused persons killed the husband of informant while he was going to appear as a witness in the murder case of his son in the Barh Court.

It is submitted on behalf of the petitioner that there is no allegation of firing against this petitioner. As per the FIR, specific allegation of firing is against four other co-accused Santosh Kumar, Gaurav Kumar, Ranjit Kumar and Shubham

Patna High Court CR. MISC. No.35570 of 2021(2) dt.10-09-2021 2/2 Kumar. Similarly situated co-accused Ram Murari Singh has already been granted bail by this Court and petitioner is in custody since 08.02.2021 having no criminal antecedent. Investigation is complete.

Considering the nature of accusation and period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Barh, Patna in connection with Athmalgola P.S. Case No. 219 of 2017, subject to following conditions:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the court below. (ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
