2. Petitioner seeks regular bail in connection with Chouri P. S. Case No. 166 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 109, 118(1), 74, 352, 351(2), 303(2), 3(5) of the Bharatiya Nyaya Sanhita.
3. As per prosecution case, this petitioner along with other F.I.R. named accused persons assaulted informant and his family members as a result of which, informant died during course of treatment. It is further alleged that the accused persons also snatched gold chain from the neck of informant's nephew.
4. Learned counsel for the petitioner submits that as per F.I.R., six named accused persons assaulted informant

No.23706 of 2026(2) dt.06-05-2026 2/2 however, during post-mortem, doctor has found only one injury on the head of the deceased and there is no other injury on entire body of the deceased which itself falsifies the prosecution story. Petitioner claims clean antecedent and is in custody since 20.01.2026. Charge-sheet shall already been submitted.
5. However, learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.
6. Considering the nature of accusation, post-mortem report, clean antecedent and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bhojpur at Ara in connection with Chouri P.
