JUSTICE SHIVAJI PANDEY ORAL ORDER 17-11-2016 Heard learned counsel for the petitioner and the learned counsel for the State.

Learned counsel for the petitioner submits that the petitioner has applied for the post of constable (Bihar Police) against the advertisement No. 01 of 2004. As per the claim of the petitioner, he qualified in the physical test, but he has wrongly been deprived of the post of constable. In the counter affidavit in sub-paragraph (b) of paragraph No. (ii) of paragraph No. 5, it has been stated that the

Patna High Court CWJC No.13506 of 2013 (3) dt.17-11-2016 2/2 petitioner has obtained less than the minimum cut off marks and, as such, he has not been selected so much so that this matter relates to the said advertisement, all the selection has been made and whatever the vacancy is left out, the same will be consumed in another advertisement.

In such view of the matter, this Court does not find any merit. Accordingly, this writ application is dismissed. (Shivaji Pandey, J) ajaypd./- U
