The petitioner seeks modification of order dated 24.08.2015 passed in Criminal Misc. No. 24860 of 2015 by which he has been granted anticipatory bail keeping in view that the petitioner has got no criminal antecedent but it is submitted that the petitioner was accused in two other criminal cases out of which in one case there was compromise and in another case also final form is submitted.

Be that as it may, the Court has made stress that the petitioner has got no criminal antecedent and this fact has not been brought on record at the time of filing of anticipatory bail application. I do not find it a fit case to modify the order dated 24.08.2015 passed in Criminal Misc. No. 24860 of 2015. This

Patna High Court Cr.Misc. No.50525 of 2015 (2) dt.14-12-2015 application is, accordingly, rejected.

If the petitioner surrenders and pray for regular bail, the court below shall consider and dispose of the same taking into consideration the fact that in the nature of circumstance, the petitioner was granted anticipatory bail by this Court. (Prabhat Kumar Jha, J) Amin/- U
