The petitioner is apprehending his arrest in connection with Mirganj P.S.Case No.235 of 2018 , registered for offences punishable under Sections 147, 148, 149, 307, 380, 504, 427, 435 of the Indian Penal Code and Section 27 of the Arms Act. Allegation as per FIR is that 71 persons including the petitioner came and assaulted the informant and take away the ornaments.

Submission of the learned counsel for the petitioner is that a large number of persons have been made accused and nothing specific has been attributed against the petitioner as well as he has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.22360 of 2019(2) dt.08-04-2019 2/2 circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Mirganj P.S.case No.235 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
