JUSTICE ALOK KUMAR SINHA ORAL ORDER 22-04-2025 Heard learned counsel for the petitioner and learned counsel appearing for the State as well as learned counsel appearing for the Bihar State Election Authority.
2. In the present writ application, the petitioner has prayed for the following reliefs:- (i) For direction to the respondent no. 2
Patna High Court CWJC No.6252 of 2025(2) dt.22-04-2025 2/3 to decide the matter in pursuant to letter no. 1672 dated 06.12.2024 issued under the signature Secretary of the Bihar State Election Authority by which Deputy Development Officer cum Nodal Officer (Co-operative Societies), Madhubani was directed to investigate the matter regarding rigging of ballots paper by current president of Ketwana PACS under Ghoghardiha Block and submit the report to the authority to 16.12.2024 and Bihar State Election Authorities may be directed to take appropriate action in accordance with law after receiving the report at the earliest in connection with Ketwana PACS election held on 03.12.2024. (ii) For direction to the authority to take appropriate action against the Block Development Officer cum Block Election Officer (Co-operative Societies), Ghoghardiha as serious irregularity committed during the election process of Ketwana PACS, Ghoghardiha Block held on 03.12.2024.
(iii) For any other relief or reliefs for which the petitioner is deemed to be entitle in the eye of law in the facts and circumstances of the present case.
3. It is however informed to this Court that the Election of Ketwana PACS has already been held on 03.12.2024 and the result has been declared. The petitioner had participated in the said election and could not succeed. This fact has been acknowledged in the writ application also.

4. In view of the above, since the election has already concluded on 03.12.2024, the petitioner has remedy of challenging the same by filing election petition. The petitioner is granted liberty to challenge the same by filing election petition within four weeks from today, which shall be decided in accordance with law.
5. In the aforesaid circumstances, the present writ application is disposed of with the liberty granted above. (Alok Kumar Sinha, J) kiran/- U
