JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 26-10-2016 The petitioner is present physically with his learned counsel and opposite party no. 2 is also present with her learned counsel.

Both parties are ready to live jointly and for that petitioner submits that he has taken ticket for opposite party no. 2 also. The date of journey is fixed on 01.11.2016, on that date the petitioner will take away opposite party no. 2 to Sikkar at Rajasthan where he is posted. The petitioner also submits that he has been selected for the post of Railway Driver. There is cordial relation between the parties and now opposite party no. 2 does not oppose the prayer of pre-arrest bail. It is also submitted that in Protest-cum-Complaint Case No. 708 of 2014 the complainant has signed the compromise petition and the same is handed over to opposite party no. 2 to get it filed in the court below. As good sense has prevailed between the parties, now the

Patna High Court Cr.Misc. No.19412 of 2014 (19) dt.26-10-2016 petitioner will keep the opposite party no. 2 with her two minor children properly at his service place with all comfort. O. P. No. 2 is also ready to withdraw the present case i.e. Mahila P.S. Case No. 09 of 2014 in course of time.

In the facts and circumstances stated above, the petitioner above named, in case of his surrender or arrest within three months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Pratibha Kumari, Judicial Magistrate, Ist Class/concerned Court, Gaya in connection with Mahila P.S. Case No. 09 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
