JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Guthani P.S. Case No. 50 of 2014 for the offences instituted under Sections 304/34 of the IPC.
The accusation is of killing the grand-mother of the informant by pushing from the cot.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. They have falsely been implicated in the present case. Both the parties are agnates. As per the allegation, the petitioners are alleged to have pushed
Patna High Court Cr.Misc. No.27468 of 2016 (2) dt.13-07-2016 2/2 the deceased which led to death of the deceased. The case has been instituted for the offence under Section 304 of the IPC. From perusal of the postmortem report, it is evident that there is no external and internal injury on the body of the deceased. The deceased is said to be 80 years old and has died a natural death. A compromise has also been entered between the parties vide Annexure-2 to the present application.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Guthani P.S. Case No. 50/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Siwan, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
