The petitioner apprehends his arrest in Pirbahore P.S. Case No. 59 of 2016 under Section 307 and other sections of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a student and there is omni bus and general allegation of assault. The petitioner has got no criminal antecedent but from perusal of the records, it appears that it was the petitioner who was leading the mob and he came to Cavendis Hostel from C.V. Raman Hostel and assaulted the informant and other student. The injured, Shanu Kumar @ Nitish Kumar, got grievous injuries on his head.

Considering the facts and circumstances, aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail and the same is rejected.
