2. The petitioners seek bail in Maharajganj P.S. Case No. 561 of 2025 registered for offences under Sections 310(4), 310(5), 111 of BNS and Sections 25(1-B)(a), 26, 35 of the Arms Act and Sections 8, 20(B) ii B of the NDPS Act.

3. The allegation is that the petitioners were arrested with two mobile phones and SIM cards, and 1.5 kg of ganja was recovered from a plastic bag in the joint possession of the accused persons.
4. Learned counsel for the petitioners submits that no incriminating article was recovered from the possession of the petitioner namely Pawan Kumar Singh and one knife was recovered from the possession of petitioner namely Rohit Tiwary. He further submits that an intermediate quantity of contraband was recovered from the joint possession of the petitioners. It is also submitted that one country-made pistol was recovered from the possession of co-accused Prince Kumar Pandey and the petitioners have clean antecedents and they are in custody since 20.11.2025.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioners.
6. Considering that an intermediate quantity of contraband was recovered from the joint possession of the petitioners and the petitioners have clean antecedents and they are in custody since 20.11.2025, this Court is inclined to grant bail to the petitioners.

No.30561 of 2026(3) dt.27-05-2026 3/3 released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned District & Additional Sessions Judge, First-cumSpecial Judge, Siwan, in connection with Maharajganj P.S. Case No. 561 of 2025.
8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
