The petitioner seeks bail in a case registered under Sections 457, 380 of the Indian Penal Code.
Allegation is that one black colour buffalo had been stolen by unknown person from the informant's farm house and one cow of his co-villager had also been stolen. It has been submitted on behalf of the petitioner that the petitioner is in custody since 1.2.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. Stolen buffalo is said to have been recovered from the house of the petitioner. The petitioner had purchased the said buffalo. He
Patna High Court CR. MISC. No.23685 of 2019(2) dt.09-05-2019 2/2 had no knowledge that the buffalo in question was subject to theft.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri P.K. Tiwari, J.M. 1st class, Kishanganj in connection with Kurli Kot P.S. case NO.5 of 2019.
