JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 04-02-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case under section 304B, 201 and 34 of the Indian Penal Code. It is alleged that the accused persons tortured and killed the deceased for non-fulfillment of demand of dowry. Petitioner No.6 is the mother-in-law of the victim Anshu Kumari. Learned counsel for the petitioners submit that victim's pregnancy caused some complications for which she was regularly treated in the hospital. Even on the date of death i.e. 22.7.2015, she was also taken to the hospital. He further submits that the father of the victim was also informed and was present in the
Patna High Court Cr.Misc. No.52230 of 2015 (3) dt.04-02-2016 hospital.
Having regard to the facts and circumstances of the case, the petitioners, namely, Chandan Sah, Birendra Sah, Jitendra Sah, Bablu Sah, Upendra Sah and Gita Devi are directed to be released on anticipatory bail, in the event of their arrest/surrender, on furnishing bail bonds of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari Town P.S. Case No.493 of 2015.
