Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by office when called upon.

Patna High Court CR. MISC. No.23523 of 2020(2) dt.15-09-2020 2/3 The petitioner seeks bail in Special Case no. 2494 of 2020 arising out of P. R. Case no. 379 of 2020 instituted for the offence under Section(s) 30(a), 2(i)(2)(3) and 41(2) of the Bihar Prohibition and Excise Act.

211 liters of illicit IMFL is alleged to have been recovered from the godown. The petitioner has been arrested. It is submitted by the counsel for the petitioner that petitioner was engaged as a labourer for discharging some cleaning work at the godown. He was in no way concern with the alleged recovered illicit liquor nor he had any knowledge of the same. He has no criminal antecedents and is in custody since 09.03.2020.

The learned APP opposed the prayer for bail by submitting that illicit liquor is recovered from where the petitioner is arrested.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise) Patna, in connection with Special case no. 2494 of 2020 arising out of P.R. Case no. 379 of 2020, subject to the following conditions:- (i) That one of the bailors will be a close relative of the

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
