Prayer for bail of this petitioner was lastly rejected vide order dated 17.02.2021 passed in Cr. Misc. No. 5663/2021 with an observation that if the trial is not concluded within six months, the petitioner, if so advised, may renew his prayer for bail.

Learned counsel appearing for the petitioner submits that till date only charge has been framed in this case and not a single witness has been examined. Petitioner is in custody since 29.08.2019.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, the period of

No.25038 of 2022(2) dt.29-06-2022 2/2 custody of the petitioner and tardy progress of the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, West, Muzaffarpur in connection with Kudhani PS case No. 567/2019.
