JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code. Petitioners are not named in the first information report but it appears that in course of investigation, they were arrested and confessed their guilt disclosing their involvement in the present case as well as some other cases. The stolen motorcycle of the present case was recovered as it is evident from the impugned order but the learned 8th Additional Sessions Judge, East Champaran, Motihari has not mentioned in the impugned

Patna High Court Cr.Misc. No.31251 of 2016 (2) dt.11-08-2016 2/2 order as to from where the aforesaid stolen motorcycle was recovered. However, learned counsel appearing for the petitioners submits that the stolen motorcycle of the present case has not been recovered from conscious possession of the petitioners. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XIII, East Champaran at Motihari in connection with Chakia P.S.
