In the present case, the petitioner has raised a grievance that he has been deprived of the ACP's which he is entitled after 12 years and 24 years.
It appears that the petitioner is facing a criminal case vide Vigilance Case No.25 of 2008 for the offences under Sections 7/13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988.
During the pendency of the criminal case the State has not granted the benefit but after conclusion of the same if the petitioner is acquitted it goes without saying that he will be
Patna High Court CWJC No.12998 of 2010 (4) dt.19-03-2018 entitled to the benefit of ACP from the due date in accordance with law.
With the aforesaid observation and direction this writ petition is disposed of.
