Petitioner apprehends his arrest in connection with Jayrampur P.S. Case No. 18 of 2017, registered for the offences punishable under Sections 341, 323, 325,307, 504, 436/34 of the Indian Penal Code.
The case of the prosecution is that the accused persons had constructed wall, obstructed the way of the informant and the same has resulted in altercation between informant side and the accused persons, whereafter, the informant was assaulted resulting in injury to the informant.
Learned counsel for the petitioner submits that on account of the dispute pertaining to construction of the wall, present case has been lodged against the petitioner and other
Patna High Court Cr.Misc. No.32555 of 2017 (2) dt.13-07-2017 2/2 accused persons, however, a counter case has been lodged by one of the accused person. It is further submitted that the petitioner has a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to grant anticipatory bail to the petitioner.
Accordingly, let the abovenamed petitioner, in the event of his arrest or surrender in the Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M, 3rd, Sheikhpura, in connection with Jayrampur P.S. Case No. 18 of 2017 subject to the conditions enumerated under Section 438 (2) of Code of Criminal Procedure.
