2. The petitioner is apprehending arrest in connection with Darpa P.S. Case No. 94 of 2024 registered on 26.06.2024 for the offences punishable under Sections 147, 149, 341, 323, 324, 325, 307, 354, 379, 504 and 506 of the Indian Penal Code.

As per the prosecution case, the F.I.R. has been lodged against twelve named accused persons, including the petitioner, alleging that all the named accused persons dragged the informant and assaulted him while being variously armed. It is specifically alleged against the petitioner that he assaulted the informant on the head with a farsa (sharp-edged weapon), but the informant resisted the said blow with his hand, as a result of

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner and the informant are agnates and are well known to each other. The real dispute arises from a land issue, as the informant's side is attempting to forcibly grab the land belonging to the petitioner. On the petitioner's protest, a scuffle turn out, resulting in injuries on both sides. It is further submitted that there is a case and counter-case arising from the same incident, date, and place of occurrence: while the present case has been lodged by the informant as Darpa P.S. Case No. 94 of 2024, the petitioner's side has also lodged Darpa P.S. Case No. 93 of 2024. The petitioner has no criminal antecedents. Furthermore, one of the co-accused, namely Santosh Kumar @ Santosh Singh, has already been granted anticipatory bail vide order dated 08.01.2025 passed in Criminal Miscellaneous No. 88757 of 2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of four weeks from today,
