The petitioners are apprehending their arrest in connection with Shivsagar P.S. Case No. 10 of 2016 for the offences instituted under Sections 341, 323, 379,504 and 506/34 of the IPC.
The prosecution story, in brief, is that while the informant alongwith his son was going on motorcycle to pay the instalment, the petitioners and others stopped his motorcycle and snatched cash Rs.60,000/-, Mobile Phone and assaulted them. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation
Patna High Court Cr.Misc. No.32770 of 2016 (2) dt.14-12-2016 2/2 of tampering with the witnesses alleged against the petitioners. They have falsely been implicated in the present case due to previous enmity.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R. Specific allegation of theft has been alleged against the petitioners in the FIR. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioners. The same is rejected in Shivsagar P.S. Case No. 10/2016, pending in the court of learned A.C.J.M. VI, Rohtas. If the petitioners surrender in the court below the same shall be considered on its own merit without being prejudiced by the order of this Court. U.K./- (Sudhir Singh, J) U T
