The petitioner has filed this petition for modification of the order dated 24.03.2017 passed in Cr. Misc. No. 43420 of 2016 and for extension of time to deposit Rs. 13,50,000/-. The learned counsel for the petitioner submits that petitioner was granted bail vide order dated 24.03.2017 on his undertaking that that he would deposit Rs. 13,50,000/- within four months from the date of the order.

It appears that more than four months have elapsed and the petitioner has filed petition for extension of time. The petitioner had undertaken to persuade the beneficiaries who illegally withdrawn the amount from the account and if the beneficiaries did not deposit the amount the petitioner undertook

Patna High Court Cr.Misc. No.47033 of 2017 (2) dt.04-10-2017 2/2 to deposit the rest amount within four months. The petitioner himself did not obey his own undertaking.

Considering the facts aforesaid, I do not find any merit in this modification petition. Accordingly, the same is dismissed.
