ANJANA MISHRA ORAL ORDER 15-09-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending her arrest in connection with Chakmehsi P.S. Case No.08 of 2016 for allegedly having committed the offence under Sections 363, 365 and 366A of the Indian Penal Code, pending in the court of the learned Chief Judicial Magistrate, Samastipur. Diary in the present case was called for, which has since been received.

Counsel for the petitioner submits that the main allegation is against Md. Firoz and not against this petitioner. However, the victim girl in her statement made under Section 164 Cr.P.C. has categorically taken the name of this

Patna High Court Cr.Misc. No.32991 of 2016 (3) dt.15-09-2016 2/2 petitioner at all stages, stating that she had been sold by the present petitioner to the said Md. Firoz for a sum of Rs.7,000/- (Seven thousand).

As such, taking into consideration all aspects of the matter and also the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure, I am not inclined to grant anticipatory bail to the petitioner. It is, thus, rejected.
