====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 30-05-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Sessions Trial No. 229 of 2018 arising out of Suiya P.S. Case No. 13 of 2018, instituted for the offence under Section(s) 302 and 364/34 of the Indian Penal Code.

It is alleged in the written report that husband of the informant had gone for fishing along with Sitaram Yadav and he did not return. The informant made search and learnt that two accused persons have murdered her husband by sharp edged weapons.

Counsel for the petitioner submits that petitioner is not named in the written report. The name of petitioner has come merely on suspicion. In the written report there is

Patna High Court CR. MISC. No.22248 of 2019(4) dt.30-05-2019 2/2 allegation against Sitaram Yadav of taking the husband of the informant. He further submits that other co-accused has already been granted bail by this Court vide order dated 27.9.2018 passed in Cr. Misc. 48240 of 2018.

Petitioner is in custody since 27.4.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Banka, in connection with Sessions Trial No. 229 of 2018 arising out of Suiya P.S. Case No. 13 of 2018,subject to the condition that both the bailors will be the close relatives of the petitioner.
