Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Jamhore P.S. Case No. 164 of 2021 registered for offence punishable under sections 341, 323, 307, 498(A), 504, 506/34 of the Indian Penal Code.
As per allegation, the accused persons tortured the deceased, who is daughter of the informant, for non-fulfillment of demand of dowry. On 21.10.2021, the informant received a
Patna High Court CR. MISC. No.25151 of 2022(3) dt.09-02-2023 2/3 telephonic information that the accused persons were assaulting the victim and they were strangulating her. She was firstly brought to Karka Sadar Hospital and wherefrom she was referred to Medical College Jamuhar, Sasaram where she died . The learned counsel for the petitioners has submitted that the petitioners are parents-in-law of the deceased. They never demanded dowry and have falsely been implicated in this case. He has submitted further that the deceased was a neuro psychiatric patient and he was under the treatment of Dr. B.K. Sharan, who in his certificate (Annexure-5), has mentioned that she has developed suicidal tendency. The learned counsel has submitted further that she was admitted in hospital on 21.10.2021 by the petitioners themselves.
They tried their best to save the life of the deceased, but after six days of her admission in the hospital, she died. The plethora of medical papers have been annexed with the record, which shows that she was treated in the hospital and thereafter, she died. The husband of deceased is under custody.
Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each
