JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Hilsa P.S. Case No. 168 of 2016 for the offences instituted under Section 379 of the Indian Penal Code. As per the allegation, on 02.04.2016 at about 12 in the noon, the informant withdrawn Rs.50,000/- from the State Bank, Hilsa and when he reached near bus stand taking the amount in a bag, the petitioners and three other FIR named accused persons, snatched the bag containing Rs.50,000/- and fled away. The informant raised alarm but the accused persons succeeded in absconding from there.
Patna High Court Cr.Misc. No.27509 of 2016 (2) dt.13-07-2016 It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. They have falsely been implicated in the present case. There is no recovery of any theft money from the possession of the petitioners. From perusal of Anexure-3, it is evident that the matter has been compromised between the parties.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Hilsa P.S. Case No. 168 of 2016 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Hilsa, Nalanda, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
