JUSTICE VIKASH JAIN ORAL ORDER 24-08-2016 By order dated 25.07.2016, the anticipatory bail petition on behalf of the petitioner no. 1 Jai Lal Yadav @ Jai Lal Rai stood dismissed as it has become infructuous.
2. Heard learned counsel for the petitioner nos. 2 to 4 and learned APP for the State.
3. Petitioner nos. 2 to 4 apprehend their arrest for the offences alleged under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 506 of the Indian Penal Code registered in connection with Turkauliya P.S. Case No. 150 of 2016.
4. It is submitted that the petitioners have been falsely implicated and there is a case and counter case between the
Patna High Court Cr.Misc. No.30543 of 2016 (4) dt.24-08-2016 2/2 parties and they are agnates of each other. The injury attributed to the assault by Jailal Yadav and Manoj Yadav is belied from the injury report of the informant showing the cause of injury with hard and blunt substance which is simple in nature.
5. Having regard to the entirety of the facts and circumstances of the case, in the event of the petitioner nos. 2 to 4's arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkauliya P.S. Case No. 150 of 2016, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
