ANJANA MISHRA ORAL ORDER 15-09-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending her arrest in connection with Saraiya P.S. Case No.406 of 2015 (G.R. No.3092/15) for allegedly having committed the offence under Sections 467, 468, 471, 420, 34 of the Indian Penal Code.

Diary in the present case was called for, which has since been received.

Learned counsel for the petitioner submits that though the allegation against the petitioner appears to be laying the sole blame on her shoulder for having obtained the benefit of Indira Awas Scheme by getting the handicapped certificate issued in her favour, which forms the basis for such benefit to her, the

It is further submitted that the petitioner is wholly innocent and even then, she is ready to deposit whatever amount is issued in her favour. Considering the aforementioned submissions and that the petitioner is a lady having no criminal antecedents, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. (West), Muzaffarpur, in connection with Saraiya P.S. Case No.406 of 2015 (G.R. No.3092/15), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
