JUSTICE PURNENDU SINGH ORAL ORDER 01-05-2025 Heard Mr. Vijay Kr Singh No. 1, along with Mr. Randhir Kumar, learned counsels appearing on behalf of the petitioners; Mr. Abhishek Kumar, learned counsel appearing on behalf of the Informant and Mr. Nitya Nand Tiwary, learned APP appearing on behalf of the State.

2. The petitioners apprehend their arrest in connection with Ram Nagar P.S. Case No. 3 of 2025 registered under Sections 137(2), 96 and 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023.

3. As per the allegation made in the FIR, the petitioners, along with their son namely Sameer Ansari and some other persons, have kidnapped the daughter of the

4. Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and they have falsely been implicated in the present case. The petitioners are mother and father of one Sameer Ansari, against whom allegation has been made by the informant that he, along with the petitioners and some other persons, has kidnapped his daughter. Only on the basis of suspicion names of the petitioners have surfaced in the present case. The petitioners have clean antecedent. On these grounds, the petitioners seek to be released on bail.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

Considering the allegation made in the FIR, the petitioners, above named, are directed to be released on prearrest bail, in the event of their arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Sub Divisional Judicial Magistrate, Bagaha, West Champaran in connection with Ram Nagar P.S. Case No. 3 of 2025, subject to the condition as laid down under Section 482(2) of the B.N.S.S.

7. The learned District Court is directed to verify the criminal antecedent of the petitioners, as stated in paragraph no. 3 of the bail application.
