JUSTICE PRABHAT KUMAR JHA ORAL ORDER 14-01-2015 Heard the learned counsel for the petitioner and the State as well the learned counsel for the Bihar State Construction Corporation Limited.

2. The petitioner has filed this writ petition for a direction to respondent no.4, Managing Director-cum-Administrator, Bihar State Construction Corporation Limited to verify the voucher(Annexure-3) submitted by the petitioner and report the same to his parent Department.

3. The petitioner was an Assistant Engineer deputed in Bihar State Construction Corporation Limited. During the deputation, he took advance of Rs.22,499. 40 paise and submitted voucher-vide Annexure-3 in the year 1991 itself, but the Bihar

Patna High Court CWJC No.12420 of 2007 (2) dt.14-01-2015 3 / 3 State Construction Corporation did not verify the voucher nor adjusted the advance taken by the petitioner. The Corporation wrote a letter to the parent Department of the petitioner that Rs.22,499.40 paise is outstanding on the basis of which the same amount was deducted from the gratuity of the petitioner.

The Bihar State Construction Corporation Limited is directed to verify the voucher of the petitioner Gajendra Prasad Singh submitted against the temporary advance taken from the Corporation within one month from the date of production of a copy of this order and if the voucher is found genuine, adjust the temporary advance and send a letter to the parent Department so that the withheld amount of the petitioner can be paid immediately thereafter.

5. With the aforesaid direction this writ application is disposed of.
