The petitioner is apprehending his arrest in connection with Wazirganj P.S. Case No. 149 of 2022 registered for offence under Sections 413, 414 and 34 of Indian Penal Code. As per FIR, one motorcycle bearing registration no. BR01FE7237 has been recovered from the petitioner's house. It is submitted by learned counsel for the petitioner that though recovery is shown to have been effected on 30.03.2022 at about 7:00 PM, FIR has been lodged on the next day by the police officials. The same is indicative of the falsity of the allegation.

Learned APP for the State has opposed the prayer for bail. It is submitted that the motorcycle which was said to be

Patna High Court CR. MISC. No.25178 of 2023(2) dt.07-07-2023 2/2 stolen has been recovered from the petitioner's house. The circumstances give rise to a situation, in the opinion of this court, where the petitioner should not be granted the privilege of anticipatory bail.
