JUSTICE SATYAVRAT VERMA ORAL ORDER 01-12-2021 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner seeks regular bail in connection with Akodhigola P.S. Case No. 155 of 2020 dated 23.12.2020 instituted for the offences under Sections 341, 323, 302, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 23.12.2020, charge-sheet has been submitted in the case and has got a criminal antecedent as mentioned in paragraph '3' of the bail application. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the occurrence took place on account of dispute

Patna High Court CR. MISC. No.34350 of 2021(2) dt.01-12-2021 2/2 relating to land where it is alleged that this petitioner was also present and apart from her presence, nothing has been alleged against her and she is a lady.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner but is not able to meet the submission of learned counsel for the petitioner that in the F.I.R. no overt act has been attributed against this petitioner. Considering the fact that the petitioner is a lady, she is in custody since 23.12.2020 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Civil Court, Dehri-on-Sone, Rohtas in connection with Akodhigola P.S. Case No. 155 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C.
