2. This is the 2nd attempt of the petitioner seeking bail in connection with Lakhaura P.S. Case No. 62 of 2024 registered for the offence punishable under Sections 302 and 120(B)/34 of the Indian Penal Code.

3. Earlier the bail application of the petitioner was rejected on 02.07.2025 in Cr. Misc. No. 8573 of 2025 which reads as follows:- Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Lakhaura P.S. Case No. 62 of 2024 registered for the offence punishable under Sections 302 and 120(B)/34 of the Indian Penal Code.

3. The deceased is alleged to have been killed by the accused persons named in the F.I.R. including the present petitioner.

4. Learned counsel for the petitioner has submitted that other co-accused have been granted bail.

5. During investigation it has come in the

Patna High Court CR. MISC. No.23481 of 2026(2) dt.01-05-2026 2/2 self inculpatory statement of the petitioner and others that they have brutally killed the deceased by stabbing him in his stomach. The post-mortem report supports the brutal killing of the deceased. The petitioner is in custody since 01.07.2024.

6. Considering the self inculpatory statement of the petitioner and committing of murder of the deceased in such a brutal manner, I am not inclined to grant bail to the petitioner.

7. Accordingly, the application stands dismissed.

4. The learned counsel for the petitioner submits that in the trial, the commitment has not been done.

5. Considering the fact that the petitioner had stabbed and killed, I am not inclined to review my earlier order. Accordingly, this application for regular bail stands rejected.

6. The Principal District & Sessions Judge, East Champaran, Motihari is directed to ensure the commitment of the case so that the charges are framed at the earliest and the trial starts.
